General Terms and Conditions of Volume X Event GmbH (Tickee) for the purchase of tickets

1. Preamble
The sale of admission tickets (hereinafter referred to as tickets) for the events offered online on the portal provided by Volume X Event GmbH, Dorfstraße 8b, 25885 Immenstedt (hereinafter referred to as Tickee) shall be processed exclusively in accordance with the following General Terms and Conditions. By placing an order, the customer authorises Tickee to process the ticket sale. In addition to issuing the tickets, the process also includes dispatch and payment processing.

2. Conclusion of contract
By purchasing a ticket, a contractual relationship is established exclusively between the customer and the organiser of the event in question with regard to attendance at the event offered. By clicking on the „Order for a fee“ button, the purchaser submits an offer to conclude a contract. By sending the ticket (either by post or by e-mail), the purchase contract is concluded with the respective organiser.

3. Services, dispatch, prices and fees
With the purchase of the ticket (see point 2), a contract is simultaneously concluded between the Client and Tickee for the processing of the corresponding ticket purchase. Tickee will deliver the tickets purchased by the Client by post or by email, depending on the Organiser’s specifications and the Purchaser’s choice. Dispatch takes place after receipt of full payment by the Purchaser. For the provision of this service, Tickee charges a system fee and shipping costs (depending on the shipping method selected by the customer) in addition to the ticket price. The system fee may vary depending on the event and will be displayed to the purchaser during the ordering process. The total price of the order including all fees is due immediately. All prices are quoted exclusive of VAT in accordance with §19 UStG.

4. Payment processing
The respective event organisers commission Tickee with payment processing. For this purpose, Tickee has been authorised by the respective event organisers to assert all ongoing claims arising from ticket sales against the customer in its own name and for the account of the respective event organiser. The buyer can choose between the payment methods of advance payment by bank transfer and PayPal.

5. Resale
The commercial resale of tickets is prohibited.

6. Admission
Admission to an event is only possible with a valid ticket. The presentation of an order confirmation or an invoice does not authorise admission.

7. Event information
The events offered online are reported to Tickee by the organiser. Tickee does not check the reported information. Tickee therefore assumes no liability for the accuracy and completeness of the information.

8. Insolvency of the organiser
In the event of the organiser’s insolvency, any claims of the customer are exclusively against the respective organiser. The purchaser has no right to a refund from Tickee.

9. Postponement, cancellation or partial cancellation of an event
In the event of the postponement, cancellation or partial cancellation of an event, any claims of the customer shall be made exclusively against the respective organiser. The organiser may instruct Tickee to process the return of the tickets. System fees and shipping costs will not be refunded.

10. Right of cancellation, exchange
In accordance with § 312g paragraph 2 sentence 9 BGB, the right of cancellation for consumers is excluded for leisure events. An exchange of tickets is excluded.

11. Liability
The following limitations of liability do not apply to damages caused by intent or gross negligence on the part of Tickee or a legal representative or vicarious agent of Tickee, or to injury to life, limb or health. Furthermore, the following limitations of liability do not apply if Tickee has assumed a guarantee or fraudulently concealed a defect. Claims, in particular due to non-performance or poor performance, with regard to the provision of the arranged service exist only against the respective organiser. Tickee is not liable for postponement, cancellation or partial cancellation of the event, the reimbursement of tickets in the event of postponement, cancellation or partial cancellation of the event, or for any resulting damages.

12. Law
The law of the Federal Republic of Germany shall apply exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
