Cashless terms of use

These cashless terms of use govern the use of the cashless payment system ("cashless system") at events organised by Volume X Event GmbH (hereinafter "organiser"). They apply in addition to the general terms and conditions for ticket purchases but are legally independent of them.
1. General
1.1 A cashless payment system ("cashless system") is offered at the organiser's events. Guests receive a festival wristband or a chip with RFID/NFC functionality (hereinafter "chip") onto which credit can be loaded.
1.2 The credit on the chip can be used on the event grounds to pay for food, drinks, merchandise and other goods and services offered by the organiser and its contractual partners.
1.3 By topping up the chip for the first time or registering in the cashless portal, the guest accepts these cashless terms of use. The contract for the cashless system is concluded between the guest and the organiser and is legally independent of the ticket purchase contract.
2. Limited network / no electronic money
The credit stored on the chip can only be used on the organiser's respective event grounds and only for the goods and services offered there. It does not constitute electronic money within the meaning of the German Payment Services Supervision Act (Section 2 (1) No. 10 ZAG – limited network). The credit does not bear interest, is not transferable and cannot be redeemed for cash (payout exclusively in accordance with section 5).
3. Topping up credit
3.1 Top-up channels
Credit can be topped up in two ways:
- Online in the cashless portal at cashless.vlmx.de (before, during and after the start of the event)
- On site at the top-up stations on the event grounds
3.2 Payment methods
Various online payment methods are available online (e.g. credit card, SEPA direct debit, PayPal). On site, top-ups can be made with cash, debit card or credit card.
3.3 Free top-up
Topping up is always free of charge – regardless of the chosen payment method and channel.
3.4 Amounts
There are no fixed minimum or maximum amounts beyond the technical limits of the cashless system.
4. One-time activation fee
4.1 With the first top-up of the chip, a one-time activation fee of €1.50 is retained from the amount topped up. This fee is charged exclusively with the first top-up – regardless of whether it is made online via the cashless portal or on site at a top-up station. No activation fee is charged for any further top-ups.
4.2 Background
The activation fee serves to partially refinance the cashless system. It does not replace the costs of a payment system that would be incurred anyway: an infrastructure based exclusively on cash and card payments (staff, tills, terminals, change logistics, card payment fees) also causes the organiser at least comparable costs, which would otherwise be reflected in higher sales prices on site. The cashless system also offers advantages for guests: cash and cards do not have to be carried on the grounds, the risk of loss decreases and payment is significantly faster.
4.3 Voluntary nature / refund
The activation fee is voluntary. Guests who do not agree to the retention can have the €1.50 refunded in two ways:
- During the event: at the troubleshooting/info point. The refund is credited to the cashless balance of the chip.
- After the event: upon informal request by email to support@volume-x-event.de, stating the wristband/chip number. In this case, the refund is credited to the remaining balance of the chip.
This applies regardless of whether the first top-up was made online or on site.
Note: We recommend requesting the refund of the activation fee before applying for the payout of the remaining balance (section 5) so that the amount can be paid out together. A separate payout of the activation fee by bank transfer is not provided for administrative reasons.
5. Refund of remaining credit
5.1 Free of charge
The refund of unused remaining credit is free of charge for the guest. No payout, processing or refund fee is charged.
5.2 Procedure
The refund can be requested immediately after the end of the event. It is done online via the cashless portal at cashless.vlmx.de:
- Log in to the cashless portal or look up the chip
- View the remaining balance
- Enter bank details
- Submit the payout request
The payout is then made by SEPA bank transfer to the specified bank account.
5.3 No payout deadline
There is no deadline for requesting the payout. The claim to payout of the remaining credit is subject to the regular statutory limitation period pursuant to Sections 195, 199 of the German Civil Code (BGB) (three years from the end of the year in which the claim arose).
5.4 Payout from four months after the end of the event
From four months after the end of the event, payout requests must be made exclusively by email to support@volume-x-event.de, stating the wristband/chip number and the complete bank details (IBAN, BIC, account holder).
6. Loss, theft, defect
6.1 Loss, theft or defect of the chip must be reported immediately at the event's info point.
6.2 For personalised/registered chips, the remaining credit can be transferred to a replacement chip after proof of identity; the previous chip is blocked. The transfer of credit to the new chip usually takes place within 24 hours.
6.3 For unregistered chips, a transfer of credit is not possible as the chip cannot be assigned to its holder. In this case, the remaining credit is forfeited.
6.4 The guest is responsible for improper handling of the chip (mechanical damage, heat, moisture beyond normal festival use). The organiser is not liable for any resulting loss of credit.
6.5 Passing the chip on to third parties is at your own risk. Whoever is in possession of the chip can use the credit on it; a refund is excluded in this case.
7. Liability in the event of system failure
7.1 In the event of temporary technical malfunctions of the cashless system, the organiser will take reasonable substitute measures, such as switching to manual recording of transactions or permitting alternative payment methods at the sales stands.
7.2 Claims for damages against the organiser due to malfunctions or failures of the cashless system are excluded unless they are based on intent or gross negligence on the part of the organiser, its legal representatives or vicarious agents, or concern injury to life, body or health.
7.3 Credit already topped up remains unaffected by a system malfunction and can continue to be used after the system has been restored or paid out in accordance with section 5.
8. Data protection
8.1 Personal data is processed as part of the cashless system, in particular:
- Chip/wristband ID
- Top-ups (time, amount, payment method)
- Transactions (time, sales stand, amount)
- Balance
- For payouts: name and bank details
8.2 The legal basis for processing is Art. 6 (1) (b) GDPR (performance of a contract) and Art. 6 (1) (c) GDPR (legal obligations, e.g. retention obligations).
8.3 Details on processing, retention periods, service providers used and the rights of data subjects can be found in the privacy policy.
9. Final provisions
9.1 The law of the Federal Republic of Germany applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods.
9.2 Should individual provisions of these cashless terms of use be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
9.3 The organiser reserves the right to adapt these cashless terms of use for future events. For the current event, the version published at the time of the first top-up applies.
