General terms and conditions of Volume X Event GmbH (Tickee) for the purchase of tickets
1. Preamble
The processing of the sale of admission tickets (hereinafter referred to as tickets) for the events offered online on the portal provided by Volume X Event GmbH, Dorfstraße 8b, 25885 Immenstedt (hereinafter referred to as Tickee) takes place exclusively under the following general terms and conditions. By placing an order, the customer commissions Tickee to process the ticket sale. In addition to issuing the tickets, this process also includes shipping and payment processing.
2. Conclusion of contract
By purchasing a ticket, contractual relationships regarding attendance at the offered event are established exclusively between the customer and the respective organiser of the event. By clicking the button "Order with obligation to pay", the buyer submits an offer to conclude a contract. The purchase contract with the respective organiser is concluded when the ticket is sent (either by post or by email).
3. Services, shipping, prices and fees
With the purchase of the ticket (see point 2), a contract for the processing of the respective ticket purchase is simultaneously concluded between the customer and Tickee. Tickee delivers the purchased tickets to the customer by post or by email, depending on the organiser's specification and the buyer's selection. Shipping takes place after receipt of full payment by the buyer. For the provision of this service, Tickee charges a system fee and shipping costs (depending on the shipping method chosen by the customer) in addition to the ticket price. The system fee may vary depending on the event and is displayed to the buyer during the ordering process. The total price of the order including all fees is due immediately. All prices are exclusive of statutory VAT pursuant to Section 19 of the German VAT Act (UStG).
4. Payment processing
The respective organisers commission Tickee with payment processing. For this purpose, Tickee has been authorised by the respective organisers to assert all claims arising from ticket sales against the customer in its own name and on behalf of the respective organiser. The buyer can pay by advance payment via bank transfer and PayPal.
5. Resale
Commercial resale of tickets is prohibited.
6. Admission
Admission to an event is only possible with a valid ticket. Presenting an order confirmation or an invoice does not entitle the holder to admission.
7. Event information
The events offered online are reported to Tickee by the organiser. Tickee does not check the reported information. Therefore, Tickee accepts no liability for the accuracy and completeness of the information.
8. Insolvency of the organiser
In the event of the organiser's insolvency, any claims of the customer exist exclusively against the respective organiser. The buyer is not entitled to a refund from Tickee.
9. Postponement, cancellation or partial cancellation of an event
In the event of postponement, cancellation or partial cancellation of an event, any claims of the customer exist exclusively against the respective organiser. The organiser may commission Tickee to process the return of tickets. System fees and shipping costs will not be refunded.
10. Right of withdrawal, exchange
Pursuant to Section 312g (2) sentence 9 of the German Civil Code (BGB), the right of withdrawal for consumers is excluded for leisure events. An exchange of tickets is excluded.
11. Liability
The following limitations of liability do not apply to damage caused by intent or gross negligence on the part of Tickee or a legal representative or vicarious agent of Tickee, or to injury to life, body or health. Furthermore, the following limitations of liability do not apply if Tickee has assumed a guarantee or fraudulently concealed a defect. Claims, in particular for non-performance or poor performance, regarding the provision of the brokered service exist only against the respective organiser. Tickee is not liable for postponement, cancellation or partial cancellation of the event, for the refund of tickets in the event of postponement, cancellation or partial cancellation of the event, or for any resulting damage.
12. Law
The law of the Federal Republic of Germany applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods.
